Frequently asked questions
Common Questions
Do I need workers' compensation if I only have a few employees?
In most cases, yes. New York generally requires most employers to carry workers' compensation, even with only one or a few employees, including many part-time workers. Some exceptions exist, so it is a good idea to confirm your situation before going without coverage.
How is my workers' compensation premium calculated?
Premiums are typically based on your payroll and the job classifications of your employees, since some types of work carry more risk than others. Your claims history and safety record may also affect the rate over time.
Why does my carrier audit my policy at the end of the term?
Your premium is usually estimated at the start of the policy using projected payroll. At the end of the term, the carrier typically reviews your actual payroll and job classifications, which can result in an additional premium or a refund.
Does workers' compensation cover subcontractors?
It depends. If a subcontractor does not carry their own workers' compensation, their workers may be counted as your employees at audit, which can increase your premium. Our agents can help you understand what certificates of insurance to collect from the subcontractors you hire.
